    There was no search warrant for his phone. After a few hours of interrogation, the former police officer from Scotland Yard with 40 years experience simply just asked ZZ if he could hand over his phone. ZZ "voluntarily" said yes and the rest is history.

    If after having extracted the WhatsApp messages, the messages on his phone were then lost as a result of the extraction, I think that would be a very serious matter.

    However, ZZ ought to know the following. Under English law, it doesn't matter how the police obtained the evidence. It does not matter if the police stole the evidence from the defendant. The evidence is still admissible in the subsequent trial or disciplinary proceedings. I believe this is true under Malaysian and Singaporean laws as well. The Panel and the Appeals Panel follow English law.

    I asked the question earlier. How much authority and power does BWF have? Normally, when crimes are suspected, the police or relevant authority goes to the court to get a search warrant, and once the warrant is granted, they will then go to the defendant's house to search for the evidence.

    Now, BWF is acting as which authority? Obviously, they aren't law enforcers or have any similar role. The closest role I can think of is they are just an organization. As an organization, if you suspect that your employee has committed an act against you or your company policy, you will act according to your company policy. They can ask to search your devices, you can decline. The company can either fire you or sue you if they have other evidence of unauthorized activities. ZZ, in this case, may be considered an "employee" of BWF, since he's being covered by the various Codes. The reason why I think they are acting as an organization is because BWF said they requested for it and both of them gave their phones to BWF. The other point that supported that BWF is acting as an organization is that BWF noted they would have demanded for it as per the Code (paragraphs 178 to 182). If BWF is a legal authority, they wouldn't have to demand for it, but simply followed legal procedures and seize it in due time.

    In my view, if ZZ is arguing against BWF that BWF has acted improperly, then it may not have merits and is wild. Each and every company's policy are different. He should sue BWF instead and not cry foul. I'm not sure how the laws will work out for issues like this. Companies are private entities and may have international presence and typically will follow the laws in the country they are operating. However, BWF isn't exactly a private entity, but neither are they some sort of legal authority. It won't be easy for any players (badminton or otherwise) to work out what sort of rights they could have unless there's a precedent somewhere.

    ZZ can appeal, but he needs to be clear and explain why. Simply stating that BWF didn't follow procedures probably won't make the cut. BWF followed their code; they didn't do anything improper. He may argue that BWF's reasoning is not sound, but I think again, it may not make the cut given the precedents cited by BWF in soccer. So, the only way is for ZZ to sue BWF in court based on the fact that BWF noted that there's no direct evidence against them, if he truly believes that BWF has wronged him.

    KUALA LUMPUR: Zulfadli Zulkiffli should just admit to match-fixing instead of giving unacceptable reasoning.

    This is the view of former national shuttler Datuk Seri Jalani Sidek after Zulfadli claimed he was innocent and has appealed to BAM and the Sports Ministry for help.

    Former world junior champion Zulfadli was recently found guilty of match-fixing by the World Badminton Federation (BWF) and banned for 20 years and fined US$25,000 (RM98,537).

    Jalani said today the reasons given by Zulfadli in defending himself were just not good enough.

    Jalani feels that Zulfadli should just admit to match-fixing instead of putting himself in a shameful situation.

    At a press conference yesterday, Zulfadli had claimed he was a victim of an unfair trial by BWF.

    Zulfadli pointed out that the WhatsApp conversations between him and Tan Chun Seang (which were used as evidence against him) by BWF was in fact a chat about sponsorship and their activity at a casino.

    However, Jalani said: “Rather than saying he was going to casino, it’s better he admits he was wrong (match-fixing). At least he realises his wrongdoing, and maybe there are others who want to help him.

    “He has made the situation worse by admitting he was going to casino. I cannot accept such an excuse.”

    Jalani added that he believes BWF must have enough evidence to find Zulfadli and Chun Seang guilty of match-fixing.

    Jalani, a Thomas Cup hero, also urged BAM and the Sports Ministry to think carefully if they want to help Zulfadli.

    “They need to really study the case, and not end up helping the wrong people.

    “I am concerned that if we appeal and have a hearing again, the situation will get worse. Like I said before, the BWF must have solid evidence against the two players.”

    Jalani also urged BAM to impose a regulation that prohibits shuttlers from visiting casinos, and those caught be suspended.

    DS Jalani, the younger brother of Datuk Misbun and partner to Datuk Razif was right to say that zz is just adding more shame to his name when he mentioned about casino.

    IMHO, if zz were in Datuk Misbun house or in his Nusa Mahsuri office... I think he will get a nice #### on his face now........

    KUALA LUMPUR: Zulfadli's father, Zulkiffli Sidek has claimed that his son is a victim of an unfair trial by the Badminton World Federation (BWF).

    As a father and coach, Zulkiflli is certain his son is innocent of all the charges made against him, as he will not do anything to shame his family and country.

    "As his coach, father and head of the family, I am extremely sad and disappointed with what has happened to us.

    “My son is a victim of this situation. There is something terribly wrong (with the case).

    "You (BWF) charge someone without solid evidence, during the hearing in Singapore.

    “Though I wasn't inside, I know that the lawyers had answered to all your charges. But when asked which match in particular was fixed, you say that the evidence is not necessary.

    "I am sad that my son is a victim of this unjust trial. From a young age, I have raised him to be a Malaysian player.

    "Though we were always outside of the national setup (BAM), we proved that we can do it based on my coaching experience overseas. My dream was to see my son become a Malaysian champion.

    "I'm devastated, because after everything we've done for the country, including winning the world junior title (2011), my son is played out like this.

    "I will admit that I shed tears of joy, when my son became the first Malaysian boys' singles champion at the World Junior Championships, and the Negaraku was played," said Zulkiffli.

    Zulkiffli assured that he will not give up on his son, and will fight till the end.

    "With the help of God, I will fight with everything I have (to uphold the truth)."

    Zulfadli, 25, was found guilty of breaching the BWF's Code of Conduct in Relation to Betting, Wagering and Irregular Match Results, and has been slapped with a 20-year ban, as well as a US$25,000 (approximately RM98,000) fine.

    227.1. There was no evidence before the Panel that ZZ’s brothers were aware of the solicitation or acceptance of payment; nor is it in the scope of this Panel’s reasons to make a finding on that point.

    227.2. The knowledge of ZZ’s brothers of the solicitation or acceptance of payment is not necessary to satisfy the charge.

    The independent shuttler (even then) was beating bigger boys in the Under-12 100Plus national junior circuit and making heads turn – and eventually his hard work paid off when he became the first Malaysian singles player to win the 2011 Asian and world junior titles.

    What I remember about him is his humility and determination. He even saved money to buy shuttlecocks – those were the difficult times.

    I know Tan Chun Seang as a player who always carries a big smile. He was playful and cheerful despite a rather challenging badminton life.



    Plagued by injury, he was banned by the Badminton Association of Malaysia (BAM) for two years in 2009 for walking out from BAM just before the Laos SEA Games.

    Three months later, the ban was lifted.

    In 2011, the 2010 Thomas Cupper decided to turn professional to seek greener pastures (he was only earning a RM1,300 monthly allowance then) but he was served another two-year ban. Last year, he turned to coaching in Melbourne.

    Both Zulfadli and Chun Seang were good players, they were determined to excel during their younger days, worked hard and showed a positive attitude.

    So, that’s why it’s so hard to accept that these boys are now facing 20 and 15-year career-ending bans respectively for match-fixing last Tuesday.

    A two-year investigation by the Badminton World Federation (BWF) ended with the world body sourcing enough evidence between 2013 and 2016 to conclude that both had engaged in “actual and attempted match- and point-fixing and did so for the purposes of betting, based on fixed matches”.

    The 25-year-old Zulfadli held a press conference on Friday, declaring his innocence and blaming the world body for making him a scapegoat.

    Zulfadli had answers for every charge against him but sadly, they were not convincing enough.

    He said his conversation with Chun Seang was linked to a game they played in a casino and sponsorship matters. Casino? That answer did not go down well at all.

    Kento Momota of Japan was banned for a year for entering a casino in 2016! For Japan, the integrity of a player was more important that they were prepared to punish their top star and potential medallist Momota – just before the Rio Olympic Games.

    Zulfadli may have sought sympathy by telling his side of the story.

    He did get it from me but I was more grieved and saddened that the young boy that I liked and knew had thrown away a good future by making some wrong choices.

    I had expected Zulfadli and Chun Seang to come clean with what had happened and appeal to the world body to reduce the ban.

    Wow, I notice the tone changes in that "not easy" and "a very serious case". It was a different tone with Norza's statement in the beginning of BWF's investigation.

    With what face is he asking the BAM for help? The national body approached him several times in the past because of his talent, but he was never interested,” said James today.

    "He chose to follow his father (Zulkiffli Sidek) instead. Now, when he is in trouble, he seeks the aid of the BAM... so should BAM help him?
